Memorandum
of Understanding |

In
April 1999, the Transportation policy Committee approved the
Memorandum Of Understanding (MOU) among all the entities of the
MPO. The current MOU, approved by the Transportation Policy
Committee in December 6, 2007, is a complete revision of the 1999
document. The document is signed by each policy committee member
listing functional responsibilities of participating agencies.

The Unified Planning Work
Program
(UPWP) describes transportation planning and related activities
to be preformed during the two-year period by the MPO entities. The
document shows in sufficient detail "who will perform the work,
the schedule for completing it, and the expected products"
for Fiscal Year 2008 - 2009 - October 1, 2008 to September
30, 2009.

Project Prioritization
Methodology Revised Forms |

|
The Technical Advisory Committee (TAC) uses the
Project Prioritization Methodology (PPM) to
objectively rank each project on its merit based on
tangible performance measures. The MPO staff applies
the PPM to rank the projects according to their
importance within specific categories. The
Transportation Policy Committee (TPC) considers the
PPM as a tool in decision-making, but is not
obligated to base the decision solely on the PPM
rankings received from the TAC. In addition to the
tangible performance measures contained in the PPM,
the TPC will also be provided a summary of the input
received at the Public Meetings on the projects
being considered for inclusion in the TIP for
subjective evaluation in the prioritization of the
projects.

The Transportation Improvement
Program (TIP) is prepared in compliance with the
Statewide Planning, Metropolitan Planning Rules
jointly issued by the Federal Highway Administration
(FHWA) (23 CFR Part 450 and 500) and the Federal
Transit Administration (FTA) (49 CFR Part 613).
This document lists the transportation improvements
that are planned to be carried out in the next four
federal fiscal years. This TIP covers a four-year
period from October 2007 through September 2011.
The
Safe, Accountable,
Flexible, Efficient Transportation Equity Act: A
Legacy for Users (SAFETEA-LU) was
enacted August 10, 2005, as Public Law 109-59.
SAFETEA-LU authorizes the Federal surface
transportation programs for highways, highway
safety, and transit for the 5-year period
2005-2009. SAFETEA-LU requires the
metropolitan planning process
establish a cooperative, continuous, and
comprehensive framework for making transportation
investment decision in metropolitan areas. Program
oversight is a joint Federal Highway
Administration/Federal Transit Administration
responsibility.

Approved by the Corpus Christi Transportation
Policy Committee on December 7, 2006. The FY 2007 -2030 MTP is the
long range plan that contains policies, goals and objectives and
transportation improvement projects. The projects included in the MTP
are the highways and bridges, transit, bicycle,
pedestrian, water transportation, railroad, and other
transportation mode.

This
policy is intended to ensure that public participation is an integral and
effective part of the MPO activities and that decisions are made with the
benefit and consideration of important public perspectives.
This policy provides a mechanism for bringing a broad range of diverse
viewpoints and values into the MPO decision-making process.
Early public involvement enables the MPO to make more informed decisions,
improve quality through collaborative efforts, build mutual
understanding and trust between the MPO and the public it serves.

A Summary of Highway Provisions & Fact Sheets for Highway
Provisions |

|
On
August 10, 2005, the President signed into law the
Safe, Accountable,
Flexible, Efficient Transportation Equity Act: A Legacy
for Users (SAFETEA-LU).
With guaranteed funding for highways, highway safety,
and public transportation totaling $244.1 billion,
SAFETEA-LU represents the largest surface transportation
investment in our Nation’s history. The two landmark
bills that brought surface transportation into the 21st
century—the Intermodal Surface Transportation Efficiency
Act of 1991 (ISTEA) and the Transportation Equity Act
for the 21st Century (TEA-21)—shaped the
highway program to meet the Nation’s changing
transportation needs. SAFETEA-LU builds on this firm
foundation, supplying the funds and refining the
programmatic framework for investments needed to
maintain and grow our vital transportation
infrastructure.
SAFETEA-LU addresses the many challenges
facing our transportation system today – challenges such
as improving safety, reducing traffic congestion,
improving efficiency in freight movement, increasing
intermodal connectivity, and protecting the environment
– as well as laying the groundwork for addressing future
challenges. SAFETEA-LU promotes more efficient and
effective Federal surface transportation programs by
focusing on transportation issues of national
significance, while giving State and local
transportation decision makers more flexibility for
solving transportation problems in their communities. |

Congestion Management System Plan |
|
| |
|
The MPO views congestion management in the context of the
overall transportation planning process. Section 450.316 of 23 CFR Part 450, Statewide Planning. Metropolitan Planning Rule,
identify "the need to relieve congestion and prevent congestion
from occurring where it does not yet occur". Further, the rule
specifies that in the Transportation Management Areas (TMAs),
the planning process must include the development of a CMS that
provides for effective management of new and existing
transportation facilities through the use of travel demand
reduction and operational management strategies to meet the
requirements of 23 CFR 500 Subpart E. |

transportation actions and facilitate public involvement in the

April 1995, the Transportation Policy Committee adopted the Bylaws and
Operation Procedure of the MPO. This document lists the responsibilities
of the Transportation Policy Committee, the Technical Advisory Committee,
Transportation Planning Director and MPO Staff. This document
lists the composition, voting and non-voting members, and
meeting procedures of both committees. All meetings of the MPO
committees are held in accordance with the Texas Open Meeting
Law.

Funding

has observed that the initial cost estimates for
many projects approved and placed in a three-year
TIP letting schedule have been subject to requests
for substantial cost increases. The Funding Policy
sets guidelines for dealing with escalated costs. |

Air Quality Summary |
|
| |
|
In 1990, Congress amended
the Clean Air Act. Previously, the act did require that air quality be
improved, but failed to impose penalties. Additionally, enforcement was
not strong. Consequently, the Clean Air Act Amendments of 1990 (CAAA)
impose strict deadlines, mandate further reasonable progress, and fine
violators. The most imposing fines are for cities that do not meet
deadlines and do not show further reasonable progress. The Environmental
Protection Agency (EPA) can withhold Federal Highway Administration (FHWA)
funds. In Texas, the legislative response includes strengthening the
Texas Natural Resource Conservation Commission's (TNRCC) enabling
legislation and instructing the agency to preserve air quality
in near non-attainment areas. |

The
purpose of the Ozone Action Day plan is to provide
the City of Corpus Christi with effective response
procedures when an Ozone Action Day advisory is
issued by the Texas Natural Resource Conservation
Commission (TNRCC) to assist in region wide efforts to prevent area redesignation
as "non-attainment" with respect to the National Ambient Air
Quality Standard (NAAQS) for ozone. |
